These are the terms for buying and using Nocturnal Studios. By buying, activating or using it, you agree to them. If you do not agree, please do not buy or use it.

Who we are

Nocturnal ("we", "us") is based in Missouri, United States. Contact: [email protected].

Age

You must be at least 13 to buy or use Nocturnal Studios. If you are under 18, you need a parent or guardian's permission.

Your license

  • When you buy, you get a license key. It gives you a personal license to use Nocturnal Studios on one computer at a time.
  • You can move your key to a new computer. Choose "Lock workstation" in the app on the old computer, then activate the key on the new one. This works up to 3 times. If you need more, or your old computer no longer works, email us.
  • You may not share your key, sell it, rent it out or give it to someone else, except where the law says you can.
  • You may not tamper with the license checks, make or use keys that we did not issue, or copy, decompile or reverse engineer the app, except where the law allows it despite this term.
  • The app checks your license online each time it starts. If your computer is offline, the app keeps working for up to 7 days before it needs to check again.

Price and payment

  • The price is shown at checkout in US dollars. Payments are processed by Stripe. Taxes may be added where the law requires them.
  • By purchasing, you confirm that you understand this is a digital, non-physical product, and that you are authorized to use the payment method used for your purchase.
  • Due to the digital nature of this product, completed purchases are final once the files have been delivered or accessed, subject to applicable consumer-protection laws and the policies of the payment provider or platform.
  • If you have a problem with your purchase, please email us before you dispute the charge with your bank. If a payment is reversed, refunded or disputed, we may cancel the key that came with it.

What you need

A Windows PC. The DLSS 5 upscale feature needs an NVIDIA RTX graphics card. Speed and results depend on your computer, its graphics card and its drivers, and we cannot promise any particular speed or quality.

Using the app

  • You own the videos you make. You are responsible for having the rights to the videos you process and for following the law and the rules of any platform you upload to, including TikTok.
  • The app prepares video files. Uploading them is something you do yourself. We do not promise that a platform will accept, approve or promote a video.
  • Nocturnal Studios is not affiliated with or endorsed by TikTok, Stripe, NVIDIA, Topaz Labs, HandBrake, FFmpeg or any other company named here. Those names belong to their owners.

Third-party software

Nocturnal Studios works with tools made by other companies and open-source projects. They belong to their owners and are covered by their own licenses. The open-source programs we include, and where to get their source code, are listed on the notices page.

Updates

We may update the app, change or remove features, and show update messages inside it. We may also change this website.

No warranty

Nocturnal Studios is provided "as is" and "as available". To the extent the law allows, we make no promises that it will be error-free, uninterrupted or suited to a particular purpose.

Limit of our liability

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, lost data or lost videos. Our total liability for any claim is limited to the amount you paid for Nocturnal Studios. Nothing in these terms limits any right you have by law that cannot be limited.

Ending your license

You can stop using Nocturnal Studios at any time. We may cancel your license if you break these terms, share or sell your key, or a payment for it is reversed or disputed.

Governing law

These terms are governed by the laws of the State of Missouri, United States, and any dispute will be handled in the state or federal courts located in Missouri. If you live outside the United States, you keep any rights you have under the mandatory laws of your own country.

Changes to these terms

If we change these terms we will update the date at the top. Using the app after a change means you accept the new terms.
